Regulations and Therms of Use (Public Offer)
§ 1 Definitions
The terms used in these Regulations mean:
1. Regulations – these Regulations for the sale of Tickets/Goods on the Portal.
2. Portal – the portal tickets.tikhonov-concert.com, operating under the domain: tickets.tikhonov-concert.com, managed by the Operator.
3. Operator – TIKHONOV AGENCY ORGANIZADORA DE EVENTOS, a legal entity registered under the laws of Spain at the address: PTDA PARTIDA COLINA, NUM 49, 03710 CALP – (ALICANTE).
4. Event – a concert, performance, or any other cultural, entertainment, or sports event organized by the Organizer, for which Tickets are available through the Portal.
5. Organizer – an individual or entity organizing the Event.
6. Customer – an individual or entity making a Ticket Reservation on the Portal.
7. Reservation – a service that temporarily blocks the seats selected by the Customer for the Event and includes the related sale of Tickets and Goods, specifying the delivery method along with order status information.
8. Paper Ticket – a printed ticket for the Event, issued on special paper with appropriate security features.
9. PDF Ticket – an electronic ticket for the Event.
10. Ticket – a Paper Ticket or a PDF Ticket that entitles the Customer to enter the Event for which the ticket was issued.
11. Goods – books, DVDs, Blu-Ray discs, or other products and gifts related to the Event or the artist performing at the Event.
12. Newsletter – a service that periodically provides information via email/SMS about Event offers and promotions based on the Customer's provided data, in accordance with the terms described in the regulations of the website tickets.tikhonov-concert.com.
13. UPK – the Act of May 30, 2014, on Consumer Rights (Journal of Laws of 2014, item 827).
14. GDPR – REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
15. UŚUDE – the Act of July 18, 2002, on the Provision of Electronic Services (Journal of Laws 2002 No. 144, item 1204).
§ 2 Scope of the Regulations
1. These Regulations apply to all Reservations made through the Portal.
2. Making a Reservation is equivalent to accepting the Regulations.
3. The Customer confirms that they have read the Regulations by selecting the appropriate checkbox in the Portal during the Reservation process.
4. The Regulations have been prepared in accordance with Article 8(1)(1) of the UŚUDE and to fulfill the information obligations of the entrepreneur in contracts concluded outside the business premises or remotely, which the Operator, as an entrepreneur, is obliged to provide under Article 12(1) of the UPK.
§ 3 Ticket and Goods Purchase Process
1. To make a Reservation and purchase Tickets and Goods, the Customer:
a) selects an Event from the list available on the Portal,
b) chooses seats from those available for the selected Event,
c) provides their personal data,
d) confirms that they have read the Regulations by selecting the checkbox,
e) may opt in to receive the Newsletter under the terms of the regulations of the website tickets.tikhonov-concert.com,
f) selects a payment method from the list provided on the Portal,
g) if Goods are available for a given Event, their list will be displayed under the aforementioned details, and the Customer may add them to the Reservation.
2. Before confirming the Reservation, the Customer sees a summary of the order on the Portal, including the total amount to be paid.
3. The Customer is responsible for the accuracy and correctness of the data mentioned in paragraph 1.
4. The Operator sends a summary of the Reservation to the Customer's email address provided in accordance with paragraph 1(c).
5. The Customer makes the payment for the amount resulting from the Reservation using their selected payment method.
6. Upon receiving the full amount due for the Reservation, the Operator delivers the Tickets and Goods to the Customer via email to the address provided during the Reservation process, within 15 minutes from the moment the funds are credited to the account.
§ 4 Payment Methods and Reservation Validity Period
1. The Operator offers the following payment methods for Tickets and Goods from the Reservation:
a) bank transfer,
b) online payment (via transfer or payment card),
2. The available payment methods for a specific Event from those listed in paragraph 1 are provided during the Reservation process.
3. The Customer selects the delivery method for Tickets and Goods.
4. Online payments are processed by entities cooperating with the Operator, providing services for accepting payment cards and/or online transfers (PayU S.A. and Autopay S.A.).
Accepted payment card types: * Visa * Visa Electron * Mastercard * MasterCard Electronic * Maestro
5. The name of the entity/entities cooperating with the Operator, as mentioned above, is displayed in the Portal and visible to the Customer during the Ticket and Goods purchase process. To complete the transaction, the Customer's data (name, surname, email) must be shared with this entity.
6. The payment method selected by the Customer determines the Reservation validity period.
7. The Reservation validity period is:
a) for bank transfers: 3 business days
b) for online transfer payments: 12 hours
c) for online card payments: 12 hours
8. The Operator has the right to cancel the Reservation in the following cases:
a) early termination of ticket sales for a specific Event at the request of the Organizer,
b) the existence of other unpaid Reservations by the same Customer for the same Event.
9. If, within the Reservation validity period specified above, counted from the moment the Customer accepts the Reservation in accordance with § 3, the total amount due for the Reservation is not paid, the unpaid Reservation will be canceled.
10. The Customer’s personal data is processed for the purpose of concluding a purchase agreement for Tickets or Goods; the agreement is concluded at the moment of full payment of the amount due for the Reservation.
11. In the case of choosing a bank transfer, the payment can only be made to the bank account number specified in the Reservation confirmation sent to the Customer’s email address.
12. The Operator accepts transfers in Euro (EUR).
13. If payment is made in another currency or in EUR from a bank account outside of Euro zone, the Customer must choose an option for international/foreign currency transfer costs such that the full amount due is credited to the Operator’s account.
14. If the Customer transfers funds for the Reservation in a manner other than specified in paragraphs 13 and 14, the Operator will return the funds to the sender's account (Customer), deducting any transaction fees charged by the Operator’s bank.
§ 5 Canceled Events and Refunds
1. Ticket refunds are only possible in the following cases:
a) the Event is canceled, or
b) the date, venue, or significant event time is changed.
2. In cases other than those described in paragraph 1, Ticket refunds are not possible – the Customer has no right to withdraw from the contract.
3. For consumers, the limitation mentioned in paragraph 2 is based on Article 38, point 12 of the Consumer Rights Act (UPK).
4. In the case mentioned in paragraph 1(b), the Operator informs the Customer about the possibility of a Ticket refund or the option to keep the Tickets valid for the rescheduled Event.
5. The Customer must make a decision as outlined in paragraph 4 within the timeframe specified by the Operator in the Event change notification.
6. If the Customer does not make a decision within the specified period, as mentioned in paragraphs 4 and 5, it will be understood as acceptance of the rescheduled Event and the continued validity of the Tickets.
7. In cases mentioned in paragraph 1(a) and paragraphs 4-6, if the Customer chooses a refund, the Portal Operator will issue the refund promptly, no later than 30 business days, using the same payment method the Customer used for the Reservation.
§ 6 Satisfaction Survey - Event Reviews
1. The Operator provides the Customer with a free service allowing them to post reviews or opinions about Events for which they have purchased a Ticket.
2. With the Customer’s consent, the Operator may send a one-time electronic or SMS survey after the Event for feedback.
3. The optional consent to receive an email or SMS requesting survey completion is granted during the Reservation process.
4. The Operator publishes the review content along with the pseudonym chosen by the Customer in the Reviews section of the Portal.
5. When posting a review or opinion about an Event, the Customer voluntarily distributes it and guarantees that the content does not infringe on the rights of third parties, does not violate the law, and grants the Operator permission to modify or edit the content if necessary.
6. If the Customer, another person, or an entity believes that any content available on the Portal violates their rights, personal dignity, good morals, beliefs, fair competition rules, or legally protected confidentiality, they should notify the Operator immediately. Upon receiving such information, the Portal Operator will take immediate action to remove the content causing the alleged violation.
7. The Portal Operator is not responsible for content posted by Customers or other users, provided it takes appropriate action upon receiving a notification as stated in paragraph 6 above.
§ 7 Complaints
1. All Customer complaints will be reviewed by the Operator within a maximum of 10 business days and should be submitted via email to info@tickets.tikhonov-concert.com or by postal mail to the Operator’s correspondence address.
2. If a complaint does not concern the Operator, the Portal, or its operation but rather relates to the Event Organizer, the Operator will promptly forward the complaint to the Organizer.
3. In the case mentioned in paragraph 2, the complaint review period may be extended depending on the Organizer, and the Customer will be promptly notified by the Operator about any extension.
4. Any refunds or compensation resulting from a successful complaint resolution will be issued within the period specified in § 7, paragraph 7.
5. Any disputes related to services provided by the Operator through the Portal will be settled by common courts.
§ 8 Provisions Regarding Goods
1. The Operator undertakes to deliver Goods without defects.
2. A Customer who is a consumer has the right to withdraw from the contract without providing a reason, but only regarding Goods, within 14 days from the date of delivery, subject to paragraph 3.
3. The right mentioned above does not apply to Goods that are audio or visual recordings if their protective packaging has been opened after delivery, in accordance with Article 38, point 9 of the Consumer Rights Act (UPK).
4. A Customer who is a consumer may withdraw from the contract by submitting an explicit declaration to the Operator via postal mail or email to: TIKHONOV AGENCY ORGANIZADORA DE EVENTOS, a legal entity registered under the laws of Spain at the address: PTDA PARTIDA COLINA, NUM 49, 03710 CALP – (ALICANTE), email: info@tickets.tikhonov-concert.com.
5. A withdrawal form template is available on the Portal, but its use is not mandatory.
6. To meet the withdrawal deadline, it is sufficient for the Customer to send the declaration before the withdrawal period expires.
7. In the event of contract withdrawal, the Operator will refund all payments received related to that contract, including delivery costs (except for additional costs incurred due to a delivery method chosen by the Customer that differs from the least expensive standard delivery option offered by the Operator), without delay and in any case no later than 14 days from the date the Operator was informed of the Customer’s decision to withdraw.
8. The Operator will issue the refund using the same payment method the Customer used in the original transaction unless the Customer expressly agrees to a different method.
9. The Customer will not be charged any fees related to the refund due to the contract withdrawal.
10. The Operator may withhold the refund until the returned item is received or until the Customer provides proof of its shipment, whichever occurs first.
11. The Customer must return or hand over the item to TIKHONOV AGENCY ORGANIZADORA DE EVENTOS, a legal entity registered under the laws of Spain at the address: PTDA PARTIDA COLINA, NUM 49, 03710 CALP – (ALICANTE), without delay and in any case no later than 14 days from the date the Customer informed the Operator of the contract withdrawal.
12. The deadline mentioned in paragraph 11 is met if the Customer ships the item before the 14-day period expires.
13. The Customer must cover the direct costs of returning the item to the Operator.
14. The Customer is responsible only for any reduction in the item’s value resulting from use beyond what was necessary to determine its nature, characteristics, and functionality.
§ 9 Conditions and Technical Requirements for Service Provision
1. Proper use of the Portal requires the use of up-to-date web browsers compliant with the HTML5 standard, with JavaScript and SSL enabled.
§ 10 Other Provisions
1. The Operator is not liable for damages caused by the actions or omissions of the Customer or other persons, particularly for their use of the Portal in a manner inconsistent with applicable laws or the Terms and Conditions.
2. The Operator is not responsible to the Customer for the actions of Event Organizers, particularly for canceled or delayed Events, subject to the provisions of § 7.
3. A ticket that is illegible, destroyed, or damaged does not entitle the Customer to enter the Event.
§ 11 Personal Data Protection – Privacy Policy
1. The personal data administrator is TIKHONOV AGENCY ORGANIZADORA DE EVENTOS, a legal entity registered under the laws of Spain at the address: PTDA PARTIDA COLINA, NUM 49, 03710 CALP – (ALICANTE).
2. The Customer can contact the data administrator via email at: info@tickets.tikhonov-concert.com.
3. The Customer may request correction of data if it is incorrect/incomplete, deletion, restriction of processing, or data transfer.
4. Personal data will be anonymized once the legal basis for further processing expires.
5. The data retention period is determined based on the purpose of the services.
6. Information regarding personal data processed during the Reservation, purchase, and delivery of Tickets and Goods:
a) A Customer who is an individual making a reservation consents to the processing of their personal data to the extent necessary for making the Reservation.
b) The scope of processed data includes name, surname, email, and phone number, and in cases where Tickets or Goods are shipped by post or courier, also street, house number, apartment number, postal code, and city.
c) If a Reservation remains unpaid, the Customer consents to the processing of personal data for the purpose of completing the Reservation until the Event date or the resolution of any complaint process.
d) If Tickets or Goods are shipped by post or courier, it is necessary to entrust data processing to a postal operator or courier company for contract execution.
e) If payment is made via online payment systems, it is necessary to provide the name, surname, and email address to the entity processing card payments and/or online transfers.
f) The Customer has the right to file a complaint regarding the processing of their data by the Operator with the supervisory authority: the Personal Data Protection Office
